Be it remembered that the Board of Aldermen of the City of Union, Franklin County, Missouri, met in special session at City Hall, 500 East Locust Street at the hour of 6:00 p.m. on the 31st day of August, 2009, at which time there were present the following:

A quorum being present, Mayor Mike Livengood declared the Board to be in session for the transaction of business.
1. Public Hearing - City of Union 2009 Tax Rate
The Mayor opened a Public Hearing to allow the Board and any interested citizens the opportunity to review the proposed Tax Levy for the City for 2009. Members reviewed the assessment figures for 2009 provided by the County Assessor. No one spoke either in favor of or in opposition to the 2009 levy and the Mayor closed the public hearing. Audio tape of hearing will be on file in the City Clerk's office until August 31, 2010.
2. Ordinances - Originals and/or copies, including recorded votes of the following are attached hereto. Each Ordinance read a minimum of twice by title, unless otherwise noted.
a) Bill 09-160/Ordinance 3481 - 2009 City of Union Tax Rate. See pg. 98.
b) Bill 09-161/Ordinance 3482 – Amend Solid Waste Ordinance. See pg. 99.
c) Bill 09-162/Ordinance 3483 – Agreement with IESI Missouri Corporation.
The City Administrator, Russell Rost, addressed the changes regarding yard waste and the avenues of notifying the citizens of the changes. Aldermen Wurdack questioned using the Code Red system as another way of informing the citizens, whereas Russell will pursue. See pg. 100.
d) Bill 09-163/Ordinance 3484 - Agreement with URS – Comprehensive Plan 2010. See pg. 101.
3. Liquor License Application (Picnic) – I.C. Fall Festival – Doug Wilmesher -
Motion: To approve liquor license as submitted. Arand\Albrecht-2nd, approved 6-0.
4. Update – Storm Water problem – Main & Mulberry – Russell updated the Board regarding the MIRMA claim of storm water damage at the building on Main and Mulberry owned by Mike Schroeder, whereas the claim has been denied. Bids have gone out regarding milling of the street in front of this property to help with the storm water. Mayor and Board discussed the storm water that gathers in this area, and questioned the expense for such repair.

5. Miscellaneous –
Park Director, Kevin Arand, reported he received a request from Don Blair of the Union FFA to use the fairgrounds September 20th for an Antique Tractor Pull in conjunction with the FFA, as they have done in the past. Board discussed the event, additional insured endorsement required and safety issues.
Motion: To recommend approving the request for use of the fairgrounds for the antique tractor pull, provided all required documents are met for insurance and safety. R.Schmuke/Wurdack-2nd, approved 6-0.
Russell requested to add vandalism in the park to the next committee meeting of the Parks, Building, Development and Public Service agenda. He then informed the Board that the County has asked to use the pool parking lot for people to park while taking a tour of area cemeteries on October 7, 2009, which he has approved.
6. ADJOURNMENT
a) Adjourn special session
Motion: There being no further business to transact, motion made and approved to adjourn the special session of the Board of Aldermen. Arand/Stowe-2nd, approved 6-0.
